Three Strikes Law

46. Respond to the following in a minimum of 250 words:
· Three strikes laws are considered by many to be extremely harsh since minor offenses can lead to long sentences. Would you support three-strikes laws for white-collar crimes over $100,000, since a single white-collar crime can cause harm to hundreds of victims and many white-collar crimes are committed by people who live an upper-class lifestyle? Which criminological theories or philosophies support your position and which ones oppose your position?

Three-strikes laws that target white-collar crimes that have the requirement of a $100,000 limit are not something I’d be able to favor. A mandatory life sentence with or without parole is handed down to offenders who are guilty of certain crimes in the”3 Strikes” law “3 strikes” law that has the backing of state legislators, Congress, and even the President (Shestak and Khalikova, 2021). Despite its enticing Major League symbol, the law falls short because of the following reasons. Although the advocates of it appear to be innovative, “3 Strikes” is just a re-imagining of an old concept. States have for years had laws for habitual offenders and recidivists. Repeat offenders face severe punishments under these laws, including and including life sentences. Minimum sentence requirements that are in many states as well as the 1987 Federal Mandatory Sentencing are both very harsh on repeat offenders (Swofford 2018, 2018). While “3 Strikes” laws are unconstitutional the government could be justified in securing repeat offenders more harshly than first-time offenders. Furthermore, “3 Strikes” laws supporters claim that they can deter violent criminality. However, it’s unlikely that the laws will stop a lot of violent crimes that are committed by criminals. First of all, the most violent crimes don’t happen in advance. They’re committed out of anger, excitement, or even while drunk. The threat of life-long imprisonment isn’t enough to stop anyone from acting out of impulsivity and without taking into consideration the potential consequences of their actions. Cont…
